Talking Points
Resolution 1
- The MN House of Representatives has the constitutional duty to oversee the Judiciary through the ability to impeach.
- This is not being done.
- A number of the House Reps. don't even know that they have this responsibility.
- The Judicial oversight board established in the Judicial Branch is covering up the corruption going on in the courts.
- This resolution would send the message that a mechanism for the House to do its job needs to be established.
- Judges are falsifying transcripts, removing evidence from case files, not fulfilling ministerial duties, and ignoring the law in rulings.
Resolution 2
- Children are more important than money. Yet a thief will get a jury trial but a parent who is about to lose their children has no such right.
- Because of Resolution 1 above the need for a jury trial is necessary.
- Children are being separated from their parents in order to give people jobs. When a child is placed in foster homes or adopted, money is brought into a local area from the Federal and State Governments to pay for the event.
- Hundreds of Millions of dollars are being spent to fund this industry.
- Minnesota is #1 in the nation for termination of Parental Rights.
Resolution 3 through 7
- The foundation of civilized society is the traditional family.
- Children are being legally kidnapped from their parents without Due Process of Law by allegation and obscurement of facts behind the laws of confidentiality.
- Families are being destroyed by state and county run childcare systems.
- Innocent parents and child care givers are being arrested without probable cause.
- Respect for law enforcement is being undermined by this aberrant behavior.
- Parental authority has been abolished by our current system.
- Children are being placed in various undesirable environments.
- Children are given power to have their parents falsely arrested for any reason whether true or not.
- This current state of our child care system, in this context, has created a police state.
- Children are encouraged to rebel further as they see the law that enables them to avoid discipline and overrule the disciplinary authority of their parents.
- These same children will further stress an already failing system.
- No compensation, apology, or restitution is required for the innocent victims of this aberrant governmental behavior.
- No responsibility is assumed by those exercising these aberrant acts of injustice.
- In this context, the justice we have come to expect and demand as citizens is corrupted or eliminated.
- In this context, the rule of law has been eliminated within the current system.
- Parents are forever stigmatized by these false allegations.
- Our public school system is losing enrollment due to our failing child protection system.
- Taxpayer dollars are being wasted on unnecessary and damaging processes, procedures, and hearings.
- Our courts are overrun with bogus case loads that further burden the taxpayer.
- In this context, the current system for child protection makes a mockery of, and attempts to destroy many desirable attributes of our justice system, our traditional family structure, parental authority, public school authority, and law enforcement authority,
Resolution 8
- The concept is "innocent until proven guilty"
- The goal is to maximize each parents time with their children.
- Children want, desire and need, both Parents in there lives.
- Parenting time of non-custodial parent is greatly reduced or ignored.
- Divorce rates are less in States that have a Presumptive Joint Physical Custody
- Mental health of children. Higher suicide, teen pregnancy, crime, and other social ills when a father is removed from the family.
- Emotional/financial stresses frequently are causes for suicide/homicide.
- Frequently children are alienated from non-custodial parent.
Resolution 9
- Both parents need to be responsible for the cost of raising their children.
- Custodial parents income in not considered when determining child support costs.
- The law that passed last year did not do this even though they say it did.
- Cost must be actual cost based on reasonable needs of the children.
- An Economist must do the calculation of presumptive child support cost based federal law. This has not been done.
- There must be a strong rebut able clause in the law so one can prove the cost otherwise.
- Current laws reward the winner of custody with money, encouraging a custody battle.
- This creates more divorces.
- Because of the inequities in Child support children are being removed from one of their parents life.
- Limited assets of non-custodial parents frequently cause bankruptcy.
- Non-custodial parents are limited in their ability to pay federal taxes.
Resolution 10
- This is the method of determining the actual cost of raising a child.
- ie. Rent $1200/m 3 people in a home = $400/person for per capita calculation.
- Marginal cost would be the cost of the rent (1200) minus the cost for a single apartment (800) = $400 for the marginal (additional cost) for two children to live there.
- The marginal cost for the phone bill if it was $100 would be $0. The per capital would be $33.
Resolution 11
- No hidden alimony
- Child support needs to be for child support not for the custodial parent.
Resolution 12
- This goes along with Resolution 2. Removing a child from a parent should be a protected right so that it does not happen unless a crime is committed.
- The parent who is wanting to move the child away needs to prove why it is best for the child and/ or give up their custodial rights if they are going to move.
Resolution 13
- Men are specifically excluded by law from obtaining shelter service from the state government if they have been abused.
- Most victims of DV are male.*
- Violence against men is no less severe than Violence against women.*
- Women who abuse are not normally action in self-defense. *
- Most child abuse victims are male.*
- Violence against males is increasing.*
- Violence against females is decreasing. *
- Violence by males is decreasing.*
- Violence by females is increasing.*
- Domestic violence against men is the most under-reported crime.*
- The field of domestic abuse research and treatment is dominated by gender bigots.*
- Women who claim to be victims are not always telling the truth.*
- Males are the primary targets of gender bias in the American legal system.*
