Dear Sirs:

The decision for my divorce just came down from Judge Mossey in Wright County. The dissolution proceeding started May of 2003. My ex-wife was having an affair and I finally had enough. She filed first after I had requested a divorce. We have two daughters that are 8 and 10. My ex-wife worked part time as a bartender. Most nights after she worked she would not come home until 4:00am. She was partying with meth addicts and she also had an association with the professional wrestler from Minnesota that died of a coke overdose. Judge Mossey was also the judge for the temporary hearing. The temporary hearing took place in July of 2003. Judge Mossey ruled in favor of my ex-wife. He awarded her $2000 a month in child support and ordered that I pay for the house payments during the proceedings. I provided substantial evidence to prove my claims.

Luckily, I was able to arrange a parenting plan with my ex that allowed me to have my daughters half of the nights. During the proceedings the court ordered a custody evaluation to be done by Wright County Human Services. The evaluator's recommendation was that we share joint physical custody of our children. Great importance was given to all factors of "the best interests of the children".

Do to the length of the trial and my financial situation, I represented myself through the remainder of the proceedings. I did a lot of research and represented myself to the best of my ability. I actually thought I did a better job then her attorney.

Judge Mossey in his Findings of Fact, Conclusion of Law, Order For Judgment And Decree was so biased and discriminatory. He awarded my ex sole physical custody, the marital homestead, alimony for 10 years, and child support at full guidelines.

I had a non-marital interests in our homestead. I provided documentation showing that I owned a previous property before I was married. He ruled against me even though I had sufficient documentation to prove my claim.

I am a straight commissioned mortgage banker. My commission income has been high the last two years, because of the refinance boom. I provided a seven year history showing how much income had dramatically increased over that period. I also provided information from the Mortgage Bankers Association showing this huge increase in business volume. Alimony was awarded based on the fact my income was substantially higher that hers. I know I can go back to the courts for a modification in the future. I'll probably lose everything by then.

My main contention is the custody of my two daughters. The court ordered the custody evaluation per the request of my ex-wife's attorney. The custody evaluation came back recommending joint physical custody. Judge Moseys biased decision did not take any of the expert evaluators recommendations under consideration.
